HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43664 of 2016 ORDER:

This writ petition is filed seeking to call for the records in FIR No.54 of 2016 and to quash the same.

Heard and perused the material available on record. The case of the petitioner is that the 3rd respondent registered a case in Crime No.54 of 2016 against the petitioner, who is A-3, and others on the complaint lodged by the 4th respondent alleging that one Md. Yahiya, who is A-1 in the said crime, has fraudulently created false service register and fake pension proposals by forgery signatures and the same were sent to the District Audit Officer to claim pension and in turn, the District Audit Officer sanctioned the pension, Gratuity, Commutation and the same were sent to ZPHS School, Vellutla, along with service register and when the 4th respondent thoroughly verified the service register of A-1, he came to know that the particulars of A-1 recorded in the service record are totally fake. The main grievance of the petitioner is that the petitioner is a retired employee and used to help retired persons to fill forms as a service and he has no knowledge about the activities of A-1, but the 3rd respondent added him as A-3 without there being any evidence.

Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.54 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
