THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN ARBITRATION APPLICATION Nos. 66, 67, 69, 70 and 74 OF 2012 COMMON ORDER:

These applications are filed for measures under Section 11(5) and

(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act').

Notice to the respondents through substituted service by way of publication has been effected. This is evidenced by the materials on record. Hence, it is declared that notices to the respondents have been duly served. In A.A. No. 69 of 2012, Advocate Sri K. Sreenivas, has entered appearance on behalf of the respondents. None has appeared nor is any representation made on behalf of the respondents when the case is called.

These applications under Section 11 of the Act have not been contested. Clauses 16 and 18 are the Arbitration Clauses. 4.

Under such circumstances, sole arbitrator is required to be appointed as it would be the requisite measure in terms of Section 11(5) and (6) of the Act.

In the result, the Arbitration Applications are allowed appointing an Arbitrator.

Ms. P.K. Kalyani, Advocate, R/o. Flat Nos. 202 and 203, Kamala Niwas, Street No.14, Himayat Nagar, Hyderabad-500029 is appointed as the Arbitrator to arbitrate on the disputes as between the applicant and the respondents in each of the above cases. The said arbitrator shall enter on reference and proceed with, as enjoined by the Act. The arbitrator will

be eligible to fix her remuneration and expenses on case to case basis, as may be found appropriate.
