THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9765 OF 2015 ORDER:

This Criminal Petition is filed by the accused No.1 under Section 482 of Cr.P.C. seeking to quash the proceedings in FIR No.74 of 2015 on the file of Srikakulam II Town Police Station, Srikakulam for the offences under Sections 420, 468, 471 r/w 34 IPC.

On perusal of the entire material available on record, prima facie there are some allegations as against the petitioner and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at this stage. It is submitted that the petitioner has already obtained bail.

In the circumstances, the petitioner is at liberty to approach this Court on filing of charge sheet, if he is aggrieved over the same, for quashing the proceedings.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
