THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8357 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in Crime No.197 of 2018 of Town-IV Police Station, Nizamabad District, registered for the offences punishable under Sections 354, 354-A, 342, 506 and 509 IPC, against the petitioner herein/accused. 2.

Learned counsel for the petitioner after arguing the matter for sometime, requested this Court to direct the police to follow the procedure laid down under Section 41-A Cr.P.C and the guidelines formulated by the Apex Court in "Rajesh Sharma v. State of U.P.1" 3.

Acceding to the request of learned counsel for the petitioner, without touching the merits of the case, I find that it is a fit case to issue direction to the police to follow the procedure laid down under Section 41-A of Cr.P.C and the guidelines issued by the Apex Court in "Rajesh Sharma's case (referred supra). Accordingly, police concerned are directed to adhere to the guidelines issued in "Rajesh Sharma v. State of U.P." (referred supra) while investigating the aforesaid crime.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
