Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents 1 to 6.

2. The petitioner was appointed as a fair price shop dealer of shop No.46 of Janapadu Village, Piduguralla Mandal, Guntur District. When the fourth respondent suspended the authorization of the petitioner on 22.08.2014, the petitioner filed W.P.No.28779 of 2014 and the same was disposed of on 10.10.2014 setting aside the order of suspension of authorization of the petitioner. Thereafter, stock was supplied to the petitioner till February, 2015. The shop was inspected on 09.02.2015 by the sixth respondent and found some variation in the stock of sugar. Based on the same, 6-A proceedings were initiated against the petitioner and the same is pending. The fourth respondent issued a show cause notice on 19.02.2015 levelling charge of shortage of 41⁄2 kgs., sugar in the stock. The petitioner submitted his explanation on 28.02.2015. No enquiry is conducted and the authorization of the petitioner is in force as on today.

In the circumstances, this Writ Petition is disposed of directing the fourth respondent to release stock to the petitioner so long as the authorization of the petitioner is in force. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
