THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8359 of 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") seeking to quash the proceedings in Crime No.162 of 2018 of ATP II Town Police Station, Ananthapur District, registered for the offence punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, against the petitioners/A.1 to A.7.

After arguing the matter for a while, learned counsel for the petitioners requested this Court to issue a direction to the police concerned to follow the procedure laid down under Section 41-A Cr.P.C and the guidelines formulated by the Apex Court in Rajesh Sharma v. State of U.P.1, while investigating into the aforesaid crime.

Acceding to the request of the learned counsel for the petitioners, without going into the merits of the case, the Criminal Petition is disposed of directing the Station House Officer, ATP II Town Police Station, Ananthapur District, to follow the procedure laid down under Section 41-A of Cr.P.C and the guidelines issued by the Apex Court in the Judgment referred to above, before taking any coercive steps against the petitioners.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
