THE HONOURABLE SRI JUSTICE A.SANTHOSH REDDY I.A.NO.07 OF 2023 AND/IN SECOND APPEAL No.199 of 2015 COMMON JUDGMENT:

The present Second Appeal is filed aggrieved by the judgment and decree dated 31.12.2014 passed in A.S.No.104 of 2011 on the file of the XI Additional District and Sessions Judge (FTC), Ranga Reddy District at L.B.Nagar, Hyderabad. 2.

I.A.No.07 of 2023 is filed by the appellants seeking permission for withdrawal of the second appeal with a liberty to file fresh comprehensive suit/proceedings in respect of same subject property against the respondents and their transferees. 3.

Learned counsel appearing for respondents submits that the permission may be accorded for withdrawal of the appeal, subject to law of limitation and defence available to them. 4.

In the facts and circumstances of the case, permission is accorded.

In the result, the I.A.No.07 of 2023 is ordered and Second Appeal is dismissed as withdrawn with a liberty to proceed in accordance with law, subject to limitation and defence available to the respondents. No costs.

Pending miscellaneous applications, if any, shall stand closed.
