HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.2299 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 and 2.

This Writ Petition is filed seeking to declare the report dated 24.11.2014 in M.C.No.268 of 2014 under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act'), as arbitrary and illegal.

The petitioner is the owner of the vehicle viz., TATA Super ACE bearing No.AP 20 TB 9982 and the same was seized on the premise that it was used in illegal transportation of essential commodities. However, the report filed under Section 6-A of the Act shows that the said vehicle was not indulged in such illegal transportation, but the same was seized on suspicion.

In view of the same, the respondents are directed to release the vehicle bearing No.AP 20 TB 9982 of the petitioner on his furnishing bank guarantee for a sum of Rs.1,00,000/-.

Accordingly, the Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
