This petition is filed under Section 438 of Cr.P.C. seeking bail to petitioner/A.1 in the event of his arrest in connection with Crime No.244 of 2021 of Langer House Police Station, Hyderabad, registered for the offences punishable under Sections 417, 420, 342, 323, 509 and 506 read with 34 of the Indian Penal Code.

Heard Mr.Mohd. Muzaferullah Khan, learned counsel for the petitioner, and learned Assistant Public Prosecutor for the respondentState. 3.

Learned Assistant Public Prosecutor submits that the police have already issued notice under Section 41-A Cr.P.C. to the petitioner on 30.10.2021 and they will follow the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1. 4.

As already police issued notice under Section 41-A of Cr.P.C. to the petitioner, this Criminal Petition is disposed of directing the police to follow Section 41-A of Cr.P.C. and also the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar (supra) scrupulously. It is needless to say, any deviation in this regard will be viewed seriously.
