THE HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO W.P.No.13710 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.

2. The case of the petitioner is that she was appointed as fair price shop dealer of Kesarapada Village, Kanchili Mandal, Srikakulam District in the year 1993 and her authorization was renewed up to 31.03.2015. While so, on 20.08.2014, the 4th respondent inspected the fair price shop of the petitioner and noticed some irregularities. Accordingly, the 3rd respondent issued a show cause notice on 08.09.2014. Since there was no suspension of her authorization and while the respondents are not supplying the stock, the petitioner was constrained to file W.P.No.29339 of 2014 and the same was disposed of by this Court directing the respondents to pass final orders. The petitioner thereafter submitted her explanation and now, a final order was passed on 27.12.2014. Challenging the same, the present writ petition is filed.

3. As against the final order dated 27.12.2014, there is a provision for appeal to the competent authority and this writ petition cannot be entertained without availing such appellate remedy.

4. In the circumstances, this Writ Petition is disposed of, giving liberty to the petitioner to approach the appellate authority, if she so chooses, within a period of 30 days from the date of receipt of a copy of this order. On receipt of such an appeal, the appellate authority shall dispose of the same as expeditiously as possible.

5. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________ A. RAMALINGESWAR RAO, J 1st June, 2015 sj
