THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5330 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioner/A1 in C.C.No.9 of 2016 on the file of the Court of XXVI Metropolitan Magistrate, Cyberabad, at Maheswaram, R.R.District. 2.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to file a petition under Section 205 Cr.P.C. before the trial Court. 3.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn granting liberty to the petitioner to file a petition under Section 205 Cr.P.C. before the trial Court. The trial Court is hereby directed to consider the application filed by the petitioner in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
