THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11581 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.4, 8 to 12 in Crime.No.168 of 2023 on the file of Noothankal Police Station, Suryapet District, registered for the offences under Sections 143, 147, 148, 324, 326 and 307 r/w. 149 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Noothankal Police is that these petitioners and others formed into unlawful assembly on the evening of 27.08.2023 and attacked brother-in-law of the de-facto complainant, who received bleeding injuries. The reason for the assault was on account of dispute with respect to fencing in the land.

Learned Additional Public Prosecutor on instructions would submit that the injuries received by the de-facto complainant were grievous in nature, however he was not hospitalized.

Keeping in view that the names of these petitioners find place in the complaint. No specific overt acts are attributed to these petitioners except stating that the petitioners were part of the said unlawful assembly, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioners/Accused Nos.4, 8 to 12 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties, for a like sum each to the satisfaction of the Principal District and Sessions Judge at Suryapet.

ii) The petitioner/Accused Nos.4, 8 to 12 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of four weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioner/Accused Nos.4, 8 to 12 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
