Etukuri Naraismha Rao v. Sri G. Narasimha Rao
THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.892 OF 2016 ORDER:
This contempt case was instituted alleging willful disobedience to the order dated 09.07.2015 passed in W.P.No.20991 of 2015. By the said order, the authority concerned was directed to consider the petitioner's representation dated 18.09.2014 and pass appropriate reasoned orders thereon in accordance with law within a time frame. Alleging inaction on the part of the Tahsildar, Khammam Rural Mandal, Khammam District, the authority concerned, the petitioner filed this contempt case. Learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that the order passed in W.P.No.20991 of 2015 was duly complied with in the year 2015 itself. Memo dated 16.11.2015 issued by the Tahsildar, Khammam (Rural), is placed on record in proof of such compliance.
Perusal of the aforestated Memo reflects that the Tahsildar referred to the order passed in the writ petition and directed the Village Revenue Officer, Maddhulapalli, to incorporate the name of the petitioner in the pahani in relation to the subject land. A copy of the Adangal/Pahani for the year 2016-2017 is also produced wherein the Village Revenue Officer, Maddhulapalli, implemented the direction of the Tahsildar and entered the name of the petitioner in the 'possessor' column as against the land admeasuring Ac.0.15 guntas in Survey No.123/1W/A1 of Maddhulapalli. In the light of the aforestated facts, this Court finds no evidence of disobedience, much less willful disobedience, warranting exercise of contempt jurisdiction.
The contempt case is accordingly closed. No order as to costs. _______________ SANJAY KUMAR,J Date:28.06.2019 GJ
