Erra Janardhan v. Mr.E. Venkatachary,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2463 of 2016 ORDER:
The order complained of non‐compliance is, in fact, not an order directing any positive steps to be taken. Notwithstanding that there is inaction on the part of the third respondent in the writ petition in spite of the order of this court, this court directed issuance of show cause notice as to why action should not be initiated against him for disobeying the orders of the court below. In other words, as on today, there is no order that is made against the third respondent. In that view of the matter, I do not find any reason to entertain the contempt case. However, petitioner is at liberty to seek appropriate direction in the writ petition apart from initiating appropriate proceedings for enforcement of the orders of the court below in E.P.No.115 of 2013 in accordance with law.
The Contempt Case is accordingly dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
