THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34882 of 2016 ORDER:

Heard Sri K.Sreenivas for petitioners and Assistant Government Pleader (Irrigation) for respondent Nos.1 to 5. The petitioners complain against the action of respondents in trying to carry out excavation works for ADIT TUNNELS through Sy.No.98 of Uyyalawada Village, Nagarkurnool Mandal, Mahabubnagar District, without following the procedure stipulated by law as illegal and unconstitutional.

The Assistant Government Pleader, on instructions, submits that the allegations in the affidavit are mere apprehensions. It is a fact that Tunnel is passing through Sy.No.98 and as and when the work progresses and the land in Sy.No.98 is likely to be affected, the respondents will proceed in accordance with law, afford opportunity to petitioners and, if necessary, take the land in accordance with law by paying compensation.

The statement is placed on record.

The writ petition is disposed of by directing the respondents not to dispossess the petitioners or disturb existing physical features of Sy.No.98 of Uyyalawada Village, Nagarkurnool Mandal, Mahabubnagar District, except in accordance with law. It is needless to observe that if a notice for acquisition or otherwise is issued, all objections available in law can be pursued and taken by petitioners. No order as to costs.
