This criminal petition is filed, by the petitioner-accused No.8, under Section 439(1)(b) of Cr.P.C., challenging the order dated 17.01.2017 in Crl.R.P.No.69 of 2016 on the file of the Court of Principal Sessions Judge, Kadapa, whereby and where under the order dated 16.09.2015 in Crl.M.P.No.546 of 2016 in Crl.M.P.No.246 of 2016 in Crime No.118 of 2011 passed by the learned Judicial Magistrate of First Class, Jammalamadugu FAC of Junior Civil Judge, Pulivendula was confirmed. 2.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State of Andhra Pradesh. 3.

Learned counsel for the petitioner submitted that the petitioner has been attending the Lingala Police Station from March 2016 without fail even on a single occasion. He further submitted that the petitioner is facing much difficulty to attend the police station for every fifteen days.

A perusal of the record reveals that the petitioner was released on bail, vide orders dated 21.03.2016 in Crl.M.P.No.246 of 2016 in Crime No.118 of 2011. While allowing the bail petition, the trial Court directed the petitioner to attend before the Station House Officer, Lingala Police Station, on every fortnight in between 10.00 a.m. and 12.00 noon till filing of charge sheet. The petitioner filed Crl.M.P.No.546 of 2016 in Crl.M.P.No.246 of 2016 seeking relaxation of the conditions imposed on 21.03.2016 and the same was dismissed by the trial Court on 16.09.2016. Feeling aggrieved by the orders of

the trial Court dated 16.09.2016, the petitioner preferred Criminal Revision Petition No.69 of 2016 and the same was dismissed by the learned Principal Sessions Judge, Kadapa, on 17.01.2017. Feeling aggrieved by the orders dated 17.01.2017, the petitioner filed the present petition for relaxation of the conditions imposed against the petitioner on 21.03.2016 in Crl.M.P.No.246 of 2016. 5.

Having regard to the facts and circumstances of the case, this Court is inclined to relax the conditions imposed in Crl.M.P.No.246 of 2016 in Crime No.118 of 2011 dated 21.03.2016 on the file of the Judicial Magistrate of First Class, Jammalamadugu. 6.

The petitioner is hereby directed to attend before the Station House Officer, Lingala Police Station, on 25th of every succeeding month till further orders of this Court.
