HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO C.R.P.No.3868 OF 2017

ORDER

This Civil Revision Petition is directed against the order dated 27.06.2017 passed in H.M.O.P.No.26 of 2014 by the Senior Civil Judge, Addanki, Prakasam District.

The petitioner herein is the husband and respondent is his wife.

During the trial, learned counsel for the petitioner intended to mark G-mail conversion and CD containing video and audio skype recording conversation, but the same was objected by the learned counsel for the respondent.

The said objection was upheld by the trial Court on the ground that there was no certification as required, by relying on the decision of the Apex Court in Anwar P.V. v. P.K.Basheer and others1.

In the present revision, though the learned counsel for the petitioner does not dispute the application of the said provision, he seeks liberty to present the said evidence after complying with the provisions of Section 65-B (2) of the Indian Evidence Act. 1 2014(10) SCC 473

Reserving such liberty, the Civil Revision Petition is closed. It is needless to observe that as and when the petitioner complies with the said provisions of the Indian Evidence Act, he is at liberty to produce the evidence. No costs.

Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 6th October, 2017 rkk
