THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.20194 OF 2009 ORDER:

The relief sought for in this Writ Petition is to declare the failure of the respondents to take steps to prevent erection of a Cell phone Tower on the premises bearing No.2-1-185/44/C, Somasundar nagar, Bagh Amberpet, Hyderabad as illegal and arbitrary; and for a consequential direction to respondents 1 and 2 to stop erection of the Tower forthwith, and ensure that no such erections are made in future. This Writ Petition, filed in the year 2009, was admitted on 22.09.2009 and status quo as on that day was directed to be maintained. It is stated that, by that time, construction of the Cell Tower was completed. The petitioner had submitted a representation to the respondent-corporation by their letters dated 25.08.2009 and 01.09.2009.

As more than eight years have since elapsed, it is but appropriate that the petitioner be permitted to make a representation afresh to respondents 1 and 2, and the respondents are directed to consider the said representation and pass orders thereupon in accordance with law at the earliest, and in any event within three months from the date of receipt of a copy of this order.
