HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 32664 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

The petitioner seeks the following relief:

"For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondents in granting licence to respondent No.4 herein just besides temple popularly known as Dongala Maisamma, situated at Dongala Maisamma Temple X Roads, as illegal, arbitrary and contrary to the provisions of the A.P. Exciose Act, 1968 and consequently direct respondent Nos.1 to 3 to forthwith consider the petitioner's representations, dated 29.09.2015 and 01.10.2015 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Learned Government Pleader for Prohibition and Excise appearing for respondent Nos.1 to 3, at the outset, submits that if the petitioner makes a representation to the Excise Superintendent, Medchal, Ranga Reddy District, he shall consider the same in accordance with law.

Learned counsel for the petitioner submits that the petitioner shall make representation to the Excise Superintendent, Medchal, Ranga Reddy District within two weeks from today.

If the petitioner makes representation within the stipulated time, the Excise Superintendent, Medchal, Ranga Reddy District shall consider the same on merits in accordance with law, as expeditiously as possible and preferably within six weeks from the date of receipt of the representation. Grant of licence in favour of respondent No.4 shall be subject to outcome of the representation. It is needless to mention that the Excise Superintendent shall grant an opportunity of being heard to respondent No.4 also.

Writ petition is accordingly disposed of.

Consequently, miscellaneous petitions, if any, also stand disposed of.
