HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1288 of 2017 ORDER :

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') requesting to quash the proceedings in C.O.R.No.1 of 2017 of Prohibition and Excise Station, Warangal Urban.

2.

The offence alleged against the petitioner is punishable under Section 8 (c) read with 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3.

Heard Smt. K. Sujatha, learned counsel for the petitioner. 4.

While advancing arguments, the learned counsel for the petitioner urges to direct the concerned police to complete the investigation in C.O.R. No.1 of 2017 and to see that the charge sheet is filed into the concerned Court.

5.

The allegations in the C.O.R. would show that 2 Kilograms of dry ganja was recovered from the petitioner's possession and she was remanded to judicial custody on 06.01.2017. In such an event, quashing of C.O.R.No.1 of 2017 does not arise. So far as the request to direct the concerned police to complete the investigation is concerned, it is difficult to even accede to such request.

6.

Accordingly, the criminal petition is dismissed at admission stage.

7.

Miscellaneous petitions pending, if any, shall stand dismissed. __________________________ A. SHANKAR NARAYANA, J 16th February 2017.
