THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.5262 of 2012 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed challenging the order, dated 21.08.2012, passed in Interlocutory Application No.294 of 2012 in Original Suit No.288 of 2011 by the Principal Junior Civil Judge, Chirala, whereunder the petition filed under Order XXVI Rule 9 and Section 151 CPC to re-direct the advocate commissioner to take measurements of ABCD (defendants plan) as per sale deed dated 30.08.1968 with the assistance of municipal surveyor and note down the existing physical features in petitioners' house, respondent's house and surroundings, which are necessary, was dismissed.

When the matter is taken up for hearing, learned counsel for the petitioners submits that the main suit was dismissed for default by the trial Court, as such the revision petition has become infructuous.
