HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36273 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not disposing of the appeal filed by the petitioner to set aside the order passed by respondent No.3 vide proceedings Rc.No.1941/ 2012 A dated 19.08.2015, as arbitrary, illegal and contrary to law.

3) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed in the month of September, 2015 till date no orders passed in the appeal.

4) The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the appeal. 5) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the Joint Collector-second respondent to dispose of the appeal filed against the proceedings Rc.No.1941/ 2012 A dated 19.08.2015 issued by respondent No.3, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of three (03)

months from the date of receipt of a copy of the order. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
