HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22034 OF 2016 ORDER:
This Writ petition is filed seeking a direction to the respondents to restore fair price shop authorization by lifting the suspension alleging that suspension of fair price shop authorization has been made on trivial grounds. It is the case of the petitioner that alleging certain variations in the stock, 6-A proceedings were initiated and finally imposed penalty of confiscation of 40% of the seized stock, which comes to the value of Rs.14,622/-, which the
petitioner had already paid. Despite paying penalty of Rs.14,622/- and Rs.500/- towards renewal of authorization, no orders have been passed.
The learned Government Pleader on written instruction from the Revenue Divisional Officer, dated 8.7.2016 submits that as a matter of fact the petitioner was issued with show cause notice on 9.1.2016 calling for explanation as to why his Fair Price Shop Dealership should not be cancelled for the reason that he diverted the essential commodities to black market. The petitioner submitted his explanation on 29.01.2016. After considering the explanation, suspension order was passed on 3.2.2016 pending enquiry. The Disciplinary proceedings initiated against the petitioner are yet to be finalized and the enquiry is posted to 16.07.2016. In the meanwhile the petitioner had approached this Court.
In the light of the facts stated supra, the Writ Petition is disposed of directing the third respondent to complete the enquiry and pass appropriate final orders at the earliest, preferably within a period of four weeks from the date of receipt of a copy of this order.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
