HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.3776 of 2007 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the proceedings of the 1st respondent in S.R. No.50 of 2006, dated 28.12.2006, as illegal and arbitrary, and consequently, direct the respondents not to evict the petitioner from the land situated in RS No.281, of an extent of Acs.5.25 cents and RS No.283 of an extent of Acs.11.93 cents of Lakshmipuram village H/ o.Dharbagudem, Jeelugumilli Mandal, West Godavari District. When the matter is taken up for hearing, learned counsel for the petitioner informed that in a similar writ petition i.e. WP No.3753 of 2007, this Court passed the following order:
" a) the respondents are directed not to dispossess the petitioner from the subject matter of the writ petition by reference to the ejectment order in S.R.No.50/ 2006 dated 28.12.2006 and; (b) if the respondents are of the view that possession of petitioner for any reason is in contravention of regulations, the respondents are under obligation to issue notice to petitioner, afford opportunity, pass orders and then dispossess the petitioner in accordance with law." In view of the same, this writ petition is also disposed of in terms of the order passed in WP No.3753 of 2007, dated 07.03.2017. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
