ORDER:

Feeling aggrieved by proceedings, vide Rc.E.1341/2008, dated 20.02.2009, of respondent No.1, whereby he has changed the earlier interim order, pending appeal filed against the order suspending the petitioner's fair price shop authorisation, the latter has filed this Writ Petition.

On 26.3.2009, this Court has granted interim direction to the respondents to supply essential commodities to the petitioner's fair price shop. At the hearing, it is not disputed by learned Assistant Government Pleader for Civil Supplies (AP) that in pursuance of the above-mentioned interim direction, the petitioner is being continued as fair price shop dealer. It is also brought to the notice of this Court that the

enquiry before respondent No.2 is still pending. In the light of these facts, respondent No.2 is directed to examine the feasibility of continuing the proceedings against the petitioner at this length of time and in case, he decides to continue the proceedings, he shall hold an enquiry, complete the same, pass a final order and communicate the same to the petitioner within two months from the date of receipt of a copy of this order. Till this exercise is completed, the petitioner shall be allowed to continue as fair price shop dealer. Subject to the above direction and observation, the Writ Petition is disposed of.
