HONOURABLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No. 1398 of 2015 ORDER:

Respondent in RCC.No.3 of 2009 in the Court of learned Principal Junior Civil Judge, Kovur is the revision petitioner. The revision petitioner assails the order dated 19.02.2015 in I.A.No.2 of 2015 rejecting the request of the revision petitioner to file additional counter to bring on record a few subsequent developments which have taken place during pendency of RCC.

Briefly stated, the subsequent developments are that the revision petitioner filed O.S.No.28 of 2012 for specific performance of agreement of sale dated 08.01.2012 against land lords/respondents herein who are said to have been executed the suit agreement. On 09.02.2015 the present application is filed, when the recording of evidence in RCC is nearing completion. The learned Rent Controller having considered the reasons stated for filing of additional counter and also the stand proposed to be taken through additional counter affidavit through the order impugned dismissed I.A.No. 2 of 2015. Hence the revision. Sri Md. Saleem, learned Counsel appearing for the revision petitioner tried to persuade this Court with several factual and legal objections against the order impugned.

Having regard to the reasons stated by the learned Rent Controller and after perusing the material available on record, I am of the considered opinion that the rejection of the revision petitioner's request to file additional counter affidavit to introduce the circumstances referred to above does not warrant interference by this Court.

The revision petition fails and is accordingly dismissed. Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed in consequence. No order as to costs.
