THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21066 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.45 of Etavakili Village, Punganur Mandal in Chittoor District. The Tahsildar submitted a report on 17.09.2014, 24.10.2014 and 28.10.2014 to the third respondent, based on which the third respondent issued three show cause notices and the petitioner submitted her explanation on 19.11.2014. When the petitioner was suspended on 13.11.2014, the petitioner filed W.P.No.36315 of 2014 and this Court passed an interim order on 27.11.2014 suspending the suspension order dated 13.11.2014. Now a final order is passed by the third respondent on 06.06.2015 cancelling the authorisation of the petitioner. Against the said order, the petitioner preferred an appeal to the second respondent along with a stay petition and the said appeal is pending. Challenging the same, the present Writ Petition is filed.

Four charges were framed against the petitioner and in respect of the charges an order was passed by the third respondent on 06.06.2015, and the petitioner was continuing as a fair price shop dealer pending the order dated 06.06.2015, by virtue of the order passed by this Court in W.P.No.36315 of 2014 dated 27.11.2014.

Since the petitioner has filed an appeal to the second respondent, the order passed by this Court on 27.11.2014 shall continue till the disposal of the appeal by the second respondent. The second respondent is directed to consider the appeal in accordance with law and pass a final order thereon, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
