G.Narashimulu ..Petitioner And The State of Telangana, represented by its Principal Secretary, Endowments Department, Hyderabad and others ..Respondents Counsel for the petitioner: Mr.N.Guru Gopal Counsel for the respondents: Government Pleader for Services (TS) The Court made the following:

ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed against the order, dated 17.11.2015 in O.A.No.4703 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad - respondent No.4 (for short 'the Tribunal'), whereby while declining to direct the respondents to consider the petitioner's case for promotion pending the disciplinary proceedings, the Tribunal, however, directed the respondents to conclude the disciplinary proceedings and pass orders within a period of four months from the date of receipt of a copy of the said order. Feeling dissatisfied with this order, the petitioner filed this writ petition. On 28.04.2016, we have adjourned the case to enable the learned Government Pleader for Services (TS) appearing for the respondents to get instructions on the stage of the disciplinary proceedings initiated against the petitioner and the time frame within which the same will be concluded.

Today, at the hearing, the learned Government Pleader for Services (TS) has submitted that the enquiry officer forwarded his report after completing the enquiry on 22.04.2016 and that the enquiry report along with a notice was sent to the petitioner on 28.04.2016. He has assured that the disciplinary proceedings will be concluded within a period of one month of receipt of the explanation from the petitioner. Having regard to the above submissions of the learned Government Pleader for Services (TS), which are placed on record, the Writ Petition is disposed of, by directing respondent No.2 to conclude the disciplinary proceedings, pass a final order and communicate the same to the petitioner within a period of one month from the date of receipt of the explanation from the latter. The petitioner's entitlement to the promotion shall depend upon the result of the disciplinary proceedings.

As a sequel to disposal of the writ petition, W.P.M.P.No.17702 of 2016 filed by the petitioner for interim relief shall stand disposed of as infructuous.
