THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.4473 of 2017 ORDER: (per SK,J) The petitioner is the applicant in O.A.No.6542 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. However, as the Tribunal stood abolished in so far as the State of Telangana is concerned owing to the notification issued by the Government of India in September, 2016, the petitioner is before this Court ventilating the very same grievance which is the subject matter of the said O.A. We are informed that by virtue of the order passed by this Court on 30.09.2016 in W.P.No.

31905 of 2016, liberty is given to any public servant working under the Government of Telangana to invoke the jurisdiction of this Court under Article 226 of the Constitution in relation to any dispute or grievance that he or she may have with regard to service conditions and in the event such a writ petition is filed, the same is to be heard by a learned single Judge of this Court. However, as the O.A. filed by the petitioner before the Tribunal is still pending and it is yet to be transferred to this Court, the petitioner is presently left with no remedy. This being the situation, Dr.K.Lakshmi Narasimha, learned counsel for the petitioner, would seek leave to withdraw O.A.No.6542 of 2015 on the file of the Tribunal so as to allow the petitioner to seek redressal of her grievance in accordance with law.

We accordingly grant leave to the petitioner to withdraw O.A.No.6542 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. The said O.A. is therefore dismissed as withdrawn. Liberty is given to the petitioner to seek redressal of the grievance

ventilated by her in the said O.A. before the appropriate forum in accordance with law. A copy of this order shall be forwarded to the Andhra Pradesh Administrative Tribunal, Hyderabad, for its information as it is still seized of the record pertaining to O.A.No.6542 of 2015. The writ petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
