THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12399 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking following relief:

"to issue Writ of Mandamus declaring the action of the 3rd respondent police personnel in interfering the civil disputes between the petitioner and the 4th respondent and also pressurizing the petitioner and his family members to pay Rs.5,00,000/- to the 4th respondent without any legal caue as illegal, arbitrary and violation of Articles 19 and 21 of the Constitution of India and consequently direct the respondent police to restrain in interfering the civil disputes between the petitioner and the 4th respondent and also pressurizing the petitioner to pay Rs.5,00,000/- to the 4th respondent without any legal cause." Heard Sri K. Maheswara Rao, learned counsel for the petitioner and learned Government Pleader for Home.

During the course of hearing, written instructions received by the office of learned Government Pleader for Home from the Inspector of Police, Anantpuram Rural Police Station, Anantapuram District, dated 30-04-2015 have been placed on record. In the said instructions it is stated that the 4th respondent herein approached the 3rd respondent herein - Inspector of Police, Anantapuram stating that one Gutta Ramanjaneyulu and Gutta Jayaramulu tried to occupy the land situated in Sy.No.178/2 of Narayanapuram village, Anantapuram District. It is further stated that the 4th respondent herein requested the police to take necessary action.

It is also stated in the said instructions that the Inspector of Police deputed the Sub-Inspector of Police to take necessary action and during the course of enquiry police had suggested the 4th respondent to approach an appropriate civil Court for redressal of his grievance. In the said instructions it is also stated that the 3rd respondent - Inspector of Police did not interfere with the civil disputes between the petitioner and the 4th respondent. It is also stated in the instructions that no F.I.R.

the Police Station does not arise. The said instructions also denied the alleged harassment. It is stated that the writ petition has been filed on mere apprehension.

In view of the above, while recording the instructions, dated 30-04-2015, the writ petition stands closed. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
