HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 3075 OF 2016 ORDER:
Petitioner is an Assistant Grade-I and Incharge MLS Point/Godown Officer, Dharmapuri, Karimnagar District. By the proceedings dated 22.1.2016 the Joint Collector &EIED, Karimnagarsecond respondent herein, placed the petitioner under suspension alleging abuse of official position and indulged in attempting to diversion of PDS sugar in to black market for pecuniary gain. Petitioner challenges this order in this Writ Petition. Learned counsel for the petitioner sought to contend that the allegation is not serious and whatever is alleged against him relates to nighttime and the petitioner has not committed any illegality or indulged in diverting the sugar meant for public distribution system.
Whether the petitioner has committed illegality and was involved in diverting the sugar meant for public distribution into black market, is a matter for consideration by the Disciplinary Authority and this Court cannot deal with that issue at this stage. This Court is not inclined to interfere with the matter of suspension and to grant relief as sought for. However, as agreed by the learned counsel for the petitioner as well as the learned Standing Counsel, this Writ Petition is disposed of directing the disciplinary authority to conclude the disciplinary proceedings, as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed. ______________________ P.
