THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40437 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondent police in not taking action on the complaints of the petitioner, dated 21.06.2016 and 06.10.2016, as arbitrary and illegal, and consequently, direct the respondent police to take action against respondents 5 and 6 and their followers. Heard and perused the material available on record. The main grievance of the petitioner is that the respondents 2 to 4 are not registering a case against the respondents 5 and 6 basing on the complaints lodged by the petitioner, dated 21.06.2016 and 06.10.2016. Considering the grievance of the petitioner, without going into the merits of the case, the respondent 2 to 4 are directed to register a case against the respondents 5 and 6, if the complaints, dated 21.06.2016 and 06.10.
2016, lodged by the petitioner disclose any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the respondents 2 to 4, he is at liberty to approach the superior officer of the 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.
Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 23, 2016.
