HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 2613 OF 2013 ORDER:
This writ petition is filed challenging the proceedings in Case No.G/823/2011, dated 04.08.2012 wherein the 3rd respondent passed orders of eviction against the petitioners. Aggrieved by the said orders, petitioners filed appeal before the 2nd respondent and same is pending.
The fact of filing appeal by the petitioners before the 2nd respondent is also admitted in the counter affidavit filed by the 4th respondent.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
When once the petitioners have filed appeal before the 2nd respondent and same is pending, this Court is not inclined to go into the merits of the case.
In view of same, the 2nd respondent is directed to dispose of the appeal filed by the petitioners against the impugned orders dated 04.08.2012, within a period of two months from the date of receipt of a copy of this order. Since it is stated that the property is in the custody of Tahsildar, status quo obtaining as on today shall be maintained till disposal of the appeal by the 2nd respondent.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY, J 20-02-2017 kvs
