THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4393 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.2, to 4, 6 & 7 under Section 482 Cr.P.C. seeking to quash the proceedings against them in CC No.1122 of 2010 on the file of X Additional Chief Metropolitan Magistrate, Secunderabad, registered for the offences punishable under Sections 420, 405 and 406 IPC. Heard and perused the material available on record. During the course of arguments, learned counsel for the petitioners submitted that the petitioners have filed discharge application before the Court below and the same is pending before the trial Court for adjudication for the past five years.

It is also submitted by the learned counsel for the petitioners that the petitioners are ready to face the trial, if the trial Court concludes the trial of the case within a period of six months and the petitioners are also willing to withdraw the discharge application pending before the Court below to enable the Court below to dispose of the case after due trial.

The petitioners are directed to withdraw the discharge application filed by them before the Court below and the Court below is directed to frame charges on the date when the discharge application is withdrawn by the petitioners and also conclude the trial of the case and dispose of the same as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
