HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18211 of 2016 ORDER:

This writ petition is filed seeking issuance of Mandamus declaring the action of the respondent authorities in issuing notices on 09.05.2016 and 28.05.2016 without giving the details of deviations made by the petitioners, as arbitrary, illegal and unconstitutional and consequently sought a direction to restrain the authorities from interfering with the petitioners' peaceful possession and enjoyment of the property in H.Nos.8-2682/32/C, 8-2-682/32/78, 8-2-682/32/80, situated at N.B. Nagar, Road No.12, Banjara Hills, Hyderabad.

Heard learned counsel for the petitioners as well as the learned Government Pleader for Municipal Administration and Urban Development Department, and also Sri P. Kesava Rao, learned Standing Counsel for the respondent - Corporation.

Though learned counsel for the petitioners raised various grounds in the writ petition, he confined his relief to the extent of directing the respondent - Corporation to consider the explanation dated 06.06.2016 submitted by the petitioners pursuant to the notice dated 28.05.2016 and pass appropriate orders in accordance with law, at the earliest.

In view of the above facts and circumstances and

without going into the merits of the case, this writ petition is disposed of directing the respondent - Corporation to consider the explanation dated 06.06.2016 submitted by the petitioners pursuant to the notice dated 28.05.2016 and pass appropriate orders in accordance with law, as early as possible, preferably within a period of two weeks from the date of receipt of a copy of this order. It is needless to mention that the authorities shall give a personal hearing to the petitioners before passing any order. Till such time, no coercive steps shall be taken against the subject property of the petitioners. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
