HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44719 of 2016 ORDER:

This writ petition is filed seeking a direction to the 3rd respondent not to interfere with the civil rights of possession and title of the petitioners over the land to an extent of Ac.3.00 gts., in Sy.No.105, Nanakramguda village, Serilingampally Mandal, R.R.District without following due process of law. Heard and perused the material available on record. The grievance of the petitioners is that without there being any complaint, the 3rd respondent at the instance of some persons who are having civil disputes with the petitioners over their ancestral property to an extent of Ac.3.00 cents, calling the petitioners to the police station and threatening them to vacate the said property.

Learned Assistant Government Pleader for Home submitted that the 3rd respondent is not intending to interfere with the civil rights of possession of petitioners over their property as alleged. Considering the facts and circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the 3rd respondent not to interfere with the civil disputes of the petitioners and not to threaten them to vacate the property as alleged in the writ petition. However, this order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioners disclosing cognizable offence. No costs.
