THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.29154 of 2009 ORDER:

The petitioner challenges proceedings Rc.No.A1/4944/2008 dated 17-12-2008 suspending the petitioner as illegal and unconstitutional.

This Court on 23.02.2010 granted interim suspension of proceedings dated 17-12-2008. Vide proceedings Rc.No.A1/885/70 dated 03-05-2010, the respondent implemented the interim order and the proceedings are placed on record and the interim order is made final order.

Accordingly, the writ petition is disposed of. If the petitioner is entitled to fixation of pay or any other relief, liberty to represent to respondent is given and the respondent is directed to consider and dispose of the same. It is needless to observe that in respect of the charges or circumstances, which led to suspension of the petitioner, are still incomplete. It is open to the respondent to take appropriate action in accordance with law.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No costs.
