THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.12788 of 2025 ORDER:

The present Criminal Petition is filed praying this Court to grant pre arrest bail to the petitioner who is arrayed as accused No.1 in Crime No.1002 of 2025 before the Kukatpally Police Station, Medchal-Malkajgiri District, registered for the offences punishable under Section 69 of BNS.

The brief facts of the case are that the complainant, a 21-year-old woman, alleged that she and the petitioner had a consensual relationship after meeting at Grace Old Age Home in 2024, during which he promised to marry her. They lived together for five months at New Balaji Nagar, Kukatpally. However, the petitioner later refused to marry her, threatened to disclose private photographs, and allegedly misappropriated her financial contribution to register a business solely in his name.

Heard Sri B.Suresh, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for petitioner submitted that the allegations are false, exaggerated, and made with malicious intent to harass and blackmail the petitioner. He further submitted that the petitioner and the complainant were in a consensual relationship, and the petitioner never coerced or deceived her. He asserted that the complainant's claims regarding financial contribution to the business are baseless, and the business was lawfully established using the petitioner's own funds. He lamented that the allegations of blackmail and threats are false. Therefore, while advocating that the petitioner is a law-abiding citizen ready to cooperate with the investigation, he prayed this Court to grant anticipatory bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the allegations against the petitioner

are of serious nature which requires investigation. Therefore, prayed the Court to dismiss the criminal petition. 6.

Having regard to rival submissions made and on going through the material placed on record, it is noted that according to complainant herself, she resided under the same roof with petitioner in Kukatpally and they were involved in business which was in the name of petitioner. The only allegation is that the petitioner refused to marry her in spite of being in relationship for considerable time. Therefore, considering the facts and circumstances of this case in detail, this Court deems it fit to grant pre-arrest bail to petitioner, subject to compliance of the following conditions: i.

The petitioner shall surrender before the Station House Officer, Kukatpally Police Station, Medchal-Malkajgiri District, within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
