HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.32141 of 2016 ORDER:

Vide present writ petition, the petitioners seek a direction, thereby directing respondents 2 to 4 not to release any further amount to the unofficial respondent No.5 pursuant to the land acquisition proceedings for the acquired lands in different extents in Sy.Nos.69/ 6, 58/ 4, 77/ 3, 69/ 3, 69/ 5, 69/ 4, 71/ 4, 93/ 1, 71/ 5 and 77/ 6 of Gonduru Village, Devipatnam Mandal, East Godavari District.

2. Learned counsel for the petitioners submits that for the aforesaid relief, the 1st petitioner sent a legal notice through her counsel on 02.03.2016 to the Special Deputy Collector, Indira Sagar Project (Polavaram), Rajamahendravaram-4th respondent and another legal notice dated 22.06.2016 to the Sub-Collector, Rampachodavaram, East Godavari District-3rd respondent. However, till date there is no response from the said respondents.

3. Keeping in view the averments made in the writ petition and the submission of the learned counsel for the petitioners, I hereby direct respondents 2 to 4 to act upon the legal notices served by the 1st petitioner and decide the same within two weeks from the date of receipt of a copy of this order. The decision taken thereon shall be communicated to the petitioners within one week thereafter. Till the decision is communicated to the petitioners, no further amount shall be disbursed in favour of the 5th respondent or any other benefits.

4. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.
