ORDER

This petition is filed under Section 482 Cr.P.C., by the petitioner seeking to quash the order dated 17.04.2018 passed in Crl.R.P.No.10 of 2018 by the Judge, Family Court-cum-Additional District Judge, Nizamabad, directing the petitioner to execute a personal bond for a sum of Rs.2,00,000/- with one surety for the like sum from any Nationalized Bank to the satisfaction of the I Additional Judicial Magistrate of First Class, Nizamabad and also imposing certain conditions. 2.

The petitioner contended that the aforesaid order is contrary to the judgment of the Apex Court in Sunderbhai Ambalal Desai v. State of Gujarat1 and that imposition of the conditions virtually amounts to denial of the relief in the petition and he requested to modify the order. 3.

Whereas the Public Prosecutor for the State of Telangana requested this Court to insist for third party security and the learned counsel for the petitioner agreed for the same. 4.

Therefore, in view of the submissions of the counsel for the petitioner and the Public Prosecutor, the petitioner is directed to furnish third party security for the value of the vehicle bearing registration No.AP 25 X 6279 (Chavrolet Spark Motor Cab) i.e., Rs.2,00,000/- to the satisfaction of the I Additional Judicial Magistrate of First Class, Nizamabad, and thereupon, the Magistrate is directed to release the said vehicle subject to the other conditions already imposed by the revisional Court.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand dismissed.
