THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9461 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.4, 7, 9 to 11 in Crime No.70 of 2022 pending on the file of Station House Officer, Sirgapur Police Station, Sangareddy District registered for the offences punishable under Sections 147, 148, 448, 324 and 307 read with Section 149 of Indian Penal Code.

Heard learned counsel for the petitioners/Accused Nos.4, 7, 9 to 11 and learned Additional Public Prosecutor for the respondentState. Perused the record. 3.

The petitioners allegedly along with other accused trespassed into the house of the de facto complainant and attacked with sticks, stones and deadly weapons, resulting in injuries to the de facto complainant.

Learned counsel for the petitioners submits that there are civil disputes which are pending, for which reason a false complaint is filed.

As seen from the complaint there are no specific overtacts attributed to these petitioners, however, the de facto complainant claims that these petitioners were part of a group which trespassed into the house of the de facto complainant and caused injuries. Since the de facto complainant was treated as outpatient, the prayer for regular bail can be considered.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.4, 7, 9 to 11 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.4, 7, 9 to 11 are directed to be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum, to the satisfaction of Judicial First Class Magistrate at Narayankhed.

ii) After release on bail, the petitioners/Accused Nos.4, 7, 9 to 11 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.4, 7, 9 to 11 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 04.11.2022 ns
