THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11607 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in Crime.No.91 of 2023 on the file of Jharasangam Police Station, Sanga Reddy District, registered for the offence under Sections 307 r/w.34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that A-1 and A-2 suffered at the hands of injured person namely one Bandi Shankar. They were planning to do awry with the said person. Both, A-1 and A-2, this petitioner and A-3 are friends. On 12.10.2023, when the injured was going to his house, this petitioner and A-3 intercepted him and took him to Mogul hotel where A-1 and A-2 attacked the victim with an iron pipe and beat him indiscriminately. 4.

Learned Additional Public Prosecutor would submit that even according to the remand report, this petitioner had not

inflicted any injury on the victim. It is specifically mentioned that A-1 and A-2 attacked the victim with an iron pipe. 5.

However, keeping in view that the petitioner is arrested on 14.10.2023 and the victim is already discharged from the hospital, the relief of regular bail can be granted, subject to following conditions:- i) The petitioner/Accused No.4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate, Zaheerabad.

ii) The petitioner/Accused No.4 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of four weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
