THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9458 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.2 in the event of his arrest in Crime No. 258 of 2022 on the file of Station House Officer, Geesugonda Police Station, Warangal District, registered for the offence punishable under Sections 420 and 306 of I.P.C.

Heard learned counsel for petitioner/Accused No.2 and learned Additional Public Prosecutor for respondent-State. Perused the record.

The defacto complainant is the brother of the deceased who filed a complaint stating that his deceased brother was an electrician and the deceased has invested an amount of Rs. 2,00,000/- in crypto currency thereby he was cheated.

Whereas, M/s.

Bhuvanasurya developers pvt.ltd also taken an amount of Rs. 2,00,000/- and gave him a bond and after completion of the term period, two cheques were given to him, which were invalid. Apart from the investment in the M/s. Bhuvanasurya developers pvt.ltd, he

was also invested with others for which reason, the deceased committed suicide.

Even according to the remand report there is no mention this petitioner in any manner dealing with the deceased regarding the investment of Rs.2 lacs in the company which is M/s. Bhuvanasurya developers pvt.ltd. The remand report does not mention the name of the petitioner as the person responsible on behalf of M/s. Bhuvanasurya developers pvt.ltd. For the said reasons, anticipatory bail for this petitioner can be considered on conditions. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.2 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Geeduganda Police Station, Warangal District within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties for a like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused No.2 shall appear before the concerned Station House Officer as and when required for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 15.11.2022 PKR
