HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8397 of 2018 ORDER :

The petitioner is A.1 among four or five accused in Cr.No.44 of 2018 of Sathyavedu Police Station, Chittoor District, registered for the offences punishable under Sections 498-A, 323,506 and 342 r/ w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard the learned counsel for the petitioner and the learned Addl.Public Prosecutor for the respondent-State opposing bail application and perused the First Information Report, bail application averments and other material on record which shows the other accused were granted regular or anticipatory bail as the Case may be but the same no way entitles the petitioner to concession of anticipatory bail for the petitioner twice went unsuccessful before the Sessions Court in getting anticipatory bail but for to say the petitioner is entitled to protection under Section 41-A CrPC as per the guidelines laid down by the Apex Court in Arnesh Kumar Vs. State of Bihar1 and the police to make efforts for counseling if possible for re-union of the couple in case the defaco-complainant is willing.

Having regard to the above, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
