This petition is filed, by the petitioner, seeking for quash of the proceedings against him in Crime No.718 of 2011 on the file of Madhapur Police Station, Cyberabad District. The offences alleged are under Sections 420 and 468 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for 1st respondent as well as the counsel appearing for the 2nd respondent.

The allegation against the petitioner is that he has processed the certificates with the forged signatures of the complainant.

The counsel for the petitioner submits that an enquiry was caused into the said aspect and the opinion was that the petitioner might be the person responsible for forging the documents. He further submits that it is only a possibility and hence, the criminal complaint cannot be maintained. 5.

But in the considered opinion of this court, the said argument is not tenable. When there is a report showing that the accused might be the person who might have forged the signatures, the matter has to be taken up for trail to understand whether he is the person who forged the signatures.

Hence, in view of the above, this court opines that it is not safe to quash the proceedings.

With the above observations, the Criminal Petition is dismissed. Interim stay granted by this court on 15.12.2011 in CRLP MP No.14929 of 2011 shall stand vacated. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
