HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18044 of 2016 ORDER:
Heard Sri Polisetty Radha Krishna, learned counsel for the petitioner, Government Pleader for respondent Municipal Administration and Urban Development and learned Standing Counsel for Greater Warangal Municipal Corporation. With the consent of both the parties, the main writ petition is taken up for disposal at the admission stage itself.
The present Writ Petition came to be filed seeking issuance of a Writ of Mandamus declaring the action of the 2nd respondent in issuing notice No.UC/03/TPS/W.No.32/CIR.9/WMC/2016 dated 26.05.2016 under Section 452(1) and 461(1) of HMC Act as illegal and arbitrary.
It is to be noted that pursuant to the show-cause notice dated 26.05.2016, an explanation was alleged to have been given by the petitioner on 28.05.2016. In view of the fact that the petitioner has submitted an explanation to the show cause notice, the question of interference by this Court with regard to very issuance of the show-cause notice does not arise. Hence, without going into the merits of the case and having regard to the facts and circumstances stated above, the present Writ Petition is disposed of directing the second respondent to pass orders on the explanation submitted by the petitioner to the show-cause notice dated 26.05.2016, as early as possible,
preferably within a period of four weeks from the date of receipt of copy of the order. If the respondent intends to take any coercive steps against the petitioner, the same shall be done by following due process of law. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
