OFFICE NOTE 29.01.2026 KL, J & BRMR, J I.A.No.1 of 2025 (on being mentioned) Heard Mr. R.K.G.Bhatia, learned counsel for the petitioner/accused No.8 and learned Assistant Public Prosecutor.

Petitioner is accused No.8 in S.C.No.583 of 2007 on the file of the learned II Additional Sessions Judge, Warangal. Vide the Judgment dated 23.08.2013, learned trial Court convicted him and other accused for the offences punishable under Sections 148 and 302 read with Section 149 of IPC and sentenced them to undergo life imprisonment. Challenging the same, petitioner preferred the appeal vide Crl.A.No.767 of 2013. Other accused also preferred the appeals. Vide common Judgment, dated 14.10.2022, this Court dismissed all the appeals.

Petitioner filed the present application seeking to list this matter under the caption 'for being mention' contending that neither the learned trial Court nor this Court considered the deposition of PW.1. Basing on the very same evidence, learned trial Court while acquitting accused No.9, convicted accused No.8 - petitioner herein.

The suggestions to PW.4 (hostile witness) by the defence counsel as fatal suggestion was may be only against accused Nos.2 to 5. Thus, there is an error in paragraph No.17 of the common judgment in the appeals. With the said contentions, he filed the present application.

The scope in a petition filed 'for being mention' is very limited. On the aforesaid ground, the petitioner herein cannot file the present application. If the petitioner is aggrieved by the Judgment passed by this Court in Crl.A.No.729 of 2013 and batch, it is for him to file Special Leave Petition, challenging the same. He cannot file the present application on the aforesaid ground.

In the light of the aforesaid discussion, this application is liable to be dismissed and accordingly, it is dismissed.
