HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28311 of 2018 ORDER:

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents, in deleting the online revenue entries of the petitioner against her land to an extent of Ac.6-12 gnts in Sy.Nos.101, 145, 150, 154, 155, 157, 158, 159, 161, 162, 449 and 451 in Sivar of Madharam village, Saligauraram Mandal, Nalgonda District and not issuing the new pattadar pass books after the integrated land survey based on the online revenue entries and not issuing the coupons for crop assistance under Rytu Bandhu scheme, as totally illegal without jurisdiction and violative and consequently direct the respondents to restore the name of the petitioner in the online revenue entries against the above said land.

2) Though various grounds are urged by the learned counsel for the petitioner, he would submit that the petitioner made a representation before the Tahasildar dated 12.06.2018 stating that she is in occupation of the land and has been cultivating the same till date. According to him, inspite of repeated demands the request made by the petitioner for issuance of pattadar passbook and crop assistance cheque were not granted.

3) The learned Government Pleader for Revenue on oral instructions states across the Bar that the petitioner is not in possession of the land and that she has sold away the said land long time back. However, the same is disputed by the learned counsel for the petitioner saying that she is in possession of the property and is having right and title over the property. According to her, the original document showing her ownership kept in the Bank for the purpose of crop loan.

4) Without going into the merits of the case, the Writ Petition is disposed of with a direction to the fourth respondent/Tahasildar to give notices to the effected parties including the petitioner in respect of lands to an extent of Ac.6.12 gts in Sy. Nos. 101, 145, 150, 154, 155, 157, 158, 159, 161, 162, 449 and 451 in Sivar of Madharam village, Saligauraram Mandal, Nalgonda District, and after hearing the parties concerned, pass necessary orders as early as possible, preferably within a period of six to eight weeks from the date of receipt of this order. There shall be no order as to costs. Miscellaneous Petitions, pending if any in this Writ Petition shall stand closed.
