HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40457 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the 4th respondent in calling the petitioner to the police station and harassing him, without any complaint against the petitioner, as arbitrary and illegal.

Heard and perused the material available on record. The main grievance of the petitioner is that since he is a witness for two transactions of sale of small plots between the 5th respondent and another, the 5th respondent is influencing the police to call the petitioner to the police station, without any complaint against the petitioner.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 4th respondent is directed not to call the petitioner to the police station unless there is a complaint against him for a cognizable offence. With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
