THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3496 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against her in C.C.No.77 of 2011 on the file of the Additional Judicial First Class Magistrate, Kothapeta.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 7-A(2)(a)&(b) r/w 41 and Rule 61-F(3) r/w Section 87 and Rule 95 Schedule XV of Factories Act. It is alleged that the petitioner failed to store the chemicals like Ferric Chloride and Sodium Carbonate separately to avoid risk and further the petitioner allowed the workers without providing and ensuring usage of personal protective equipment and the petitioner also failed to provide proper training regarding safe handling chemicals, and supervision training to the workers.

Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above case. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when her presence is specifically required by the trial Court. The petitioner is directed to be represented by a Counsel before the trial Court on all hearing dates.
